At Decision Analysis, we are committed to improving the quality of information you use to make important litigation decisions, whether it involves a focus group, a mock trial, a jury selection, a witness preparation, or crafting themes and arguments in opening/closing statements.
Each trial has its own distinct decision path that is determined by the evidence, the law, and the jury or judicial issues in the case. At Decision Analysis, we start at the end by determining with the client their optimal verdict or outcome for the case. We then employ a unique four-step DecisionPoint methodology to map out the decision path for the judge, jury, client, and even opposing counsel, to ultimately achieve that outcome or verdict.
First, we pinpoint the various factors that can impact a jury’s or judge’s verdict. These factors are mapped, studied and weighed to come up with a strategic research and communication design plan.
Second, we use the latest social, psychological, and behavioral science methodologies to study the point-by-point formation of the fact finder’s decisions. Some of the disciplines that we employ to create precision research include behavioral, clinical, educational, and social psychology as well as marketing, business, and political research. These methodologies also determine the core values and essential worldview of the jury and judge, which in turn shapes how they view the case.
Third, we take the research findings and translate the identified case strengths, weaknesses, and education issues into the most powerful and persuasive framework and case story, specifically geared to the key decision factors that we have previously identified. Our creative team uses strategies and techniques from the fields of communication, linguistics, public relations, journalism, historical research, documentary filmmaking, marketing, theater, and the visual arts to design the most evocative and compelling story of the case along with methods for presenting the case to increase juror retention of key issues and use during deliberations. This story is specifically designed to address the needs and core values of the audience as well as the communication preferences of audience that influences the key decision factors in the case.
Fourth and finally, we work with you during the trial to ensure that the essential message of the case stays consistent while adapting to the changing dynamic of judicial rulings, witness testimony, opposing counsel’s tactics, and jury reactions.
At Decision Analysis, we fill three primary roles as consultants: as your audience to help you understand how jurors, judges, and witnesses will view your case, as your opponent to help you understand and overcome any case vulnerabilities, and as your advocate to help you best frame and present the story of your case to achieve your litigation goals.
